Terms & Conditions – RCS Messaging Program

Program Name: Automation Cloud Solutions Private Limited RCS (“Service”).

1) Acceptance of Terms

By opting in to our RCS messages (via tap/“Yes”, QR, web form, app toggle, or any equivalent action), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please opt out and discontinue use.

2) Eligibility

You must be (i) at least 18 years old, (ii) the owner/authorized user of the mobile number, and (iii) using an RCS-capable device and carrier.

3) Message Types & Frequency

We may send:

Transactional: account alerts, OTPs, invoices/receipts, status updates, service notifications.

Service/Informational: product updates, policy changes, outages/maintenance notices.

Promotional/Marketing (only if separately consented): offers, recommendations, reminders.
Frequency: varies based on your activity and preferences; typically [5 messages/month] for promotional and as-needed for transactional.

4) Charges & Availability

We charge no fee for the Service. Your carrier/data charges (if any) may apply. Delivery and RCS features depend on device, OS, carrier network, and coverage. We do not guarantee uninterrupted availability.

5) Opt-In & Opt-Out

Opt-In: Tap “Agree/Yes/Join” on our RCS card, check a box on our web/app forms, or otherwise provide explicit consent.

Opt-Out (anytime):

Reply STOP in the RCS chat; or

Use the RCS Unsubscribe button/menu (if available); or

Contact us at support@aisplanet.com.
You will receive a confirmation of your opt-out. You may still receive essential transactional or legally required notices.

6) Help/Support

For help, reply HELP in the chat or contact support@aisplanet.com. Typical response time [e.g., 24–48 business hours].

7) Data, Privacy & Consent

We process your mobile number, device metadata, interaction logs (delivery/read receipts, button taps), and message content solely to provide and improve the Service, comply with law, and prevent abuse.

We follow the principles of the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable TRAI/telecom norms.

For marketing messages, we rely on your explicit, revocable consent. You can withdraw consent by opting out (Section 5).

Data retention: [12months] or as required by law/legitimate interests (e.g., fraud prevention, audit).

Sharing: We may use vetted service providers (RCS agents, CPaaS, analytics, security, cloud hosting) under data-processing agreements. We do not sell personal data.

8) TRAI/NDNC (DND) Compliance

We honour DND/NDNC preferences for promotional content. Transactional/ service-essential messages may still be delivered as permitted under TRAI guidelines.

9) Your Responsibilities

You agree to:

Provide accurate contact details and keep them updated;

Use the Service lawfully;

Not misuse, reverse engineer, scrape, spam, harass, or introduce malware;

Immediately notify us of unauthorized use or security incidents.

10) Service Changes & Beta Features

We may improve, add, or remove features (including cards, carousels, suggested actions/replies) or suspend the Service (in whole or part) with or without notice. Some features may be released as beta and could be unstable.

11) Intellectual Property

All content, templates, designs, logos, and software used in the Service are owned by us or our licensors. You receive a limited, revocable, non-transferable license to use the Service as intended.

12) Warranties & Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind—express or implied—including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant continuous, error-free, or secure operation.

13) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive damages, lost profits, or lost data.

14) Indemnity

You agree to indemnify and hold us and our partners harmless from claims, losses, liabilities, costs, and expenses arising out of your misuse of the Service or breach of these Terms.

15) Third-Party Services & Carriers

RCS delivery and features depend on third-party carriers, OEMs, Google/Android Messages (or other RCS clients), and aggregators. We are not responsible for their acts, omissions, outages, or changes.

16) Communications Records

We may log message delivery status, timestamps, IPs, device/application identifiers, and interaction metadata for compliance, troubleshooting, analytics, and anti-abuse.

17) Suspension & Termination

We may suspend or terminate your access (with or without notice) if we suspect abuse, legal non-compliance, or security risks, or to protect other users and the network.

18) Governing Law & Dispute Resolution

These Terms are governed by Indian law. Subject to , courts at Mangalore shall have exclusive jurisdiction.

Optional—Arbitration: Any dispute shall be referred to a sole arbitrator appointed in accordance with the Arbitration and Conciliation Act, 1996, seat/place [CITY], language English.

19) Changes to These Terms

We may update these Terms to reflect legal, technical, or business changes. We will indicate the “Effective Date” above and, where required, notify you via RCS or website/app. Your continued use after changes means you accept the updated Terms.
